This paper aims to clarify and defend the distinction by Isaiah Berlin between “negative liberty” on the one hand, and “positive” and “communal liberty” on the other. This distinction has been attacked by those who believe it breaks the necessary harmony with equality or fraternity, virtues that many progressive authors place on the same plane as freedom. Instead of speaking of “negative liberty,” as proposed by Berlin, we propose to call it “classical” or “formal” liberty. In turn, rather than speaking (...) of “positive” liberty, we propose to say “possessive liberty” and “communal liberty.” Thus, Isaiah Berlin should have spoken of three concepts of liberty and have stressed that the latter two may be destructive of the first. Possessive and communal liberty can be significant aspects of a society, but should not be confused with personal liberty. The promotion of possessive and comunal liberty is often accompanied by invasions of formal liberty. (shrink)

In 1821, John Bowring published, probably with only his own additions, a manuscript of Bentham's under the title of Observations on the restrictive and prohibitory commercial system: especially with a reference to the Decree of the Spanish Cortes of July 1820. It seems likely that Bentham's text was originally conceived as an appendix to a work that Bentham never published, ‘Rid Yourselves of Ultramaria’, a commentary on Spanish colonization.

The first part of this study offers a synoptic overview of Alfonso de la Torre’s selective engagement with Maimonidean philosophy in the first part of his Visión Deleitable. Our analysis is complemented with some comparative notes on the reception of Maimonides’s thought in late medieval Spain. Visión Deleitabl e’s fate will be examined in comparison to two other 15th century works of Jewish or converso authorship that also broached the Guide for the Perplexed for the benefit of Christian readers: the (...) Is John Stuart Mill’s On liberty the source of present-day boundless self-tolerance and vacuous spontaneity and eccentricity? Professor Pedro Schwartz, in his work En busca de Montesquieu (2007), claims so. This article friendly discusses (o rather disputes) Schwartz’s views.

This paper takes a phenomenological perspective regarding the difficulties encountered in daily life by man in prehistory. I argue that the economics of beingnecessarily establishes man as a being that must make choices. Of these, man must eventually arrive at the realization that higher, rather than lower choices will safeguard human survival, well being and allow for prosperity. The economics of being is a form of identifying economic choice-making as a natural disposition of man’s. It is the latter condition that (...) makes man act in the world. However, even though man must act, action cannot be blind. Instead, human action is motivated and guided by man’s sense of interiority. That is, man’s existential capacity for self-reflection is also what can deliver us to autonomous rule. This form of reflective choice-making is a creative act. The paper attempts to trace this aspect of the human condition back to prehistory, in order to demonstrate that societies, institutions, invention, technology, artistic creation and economic responsibility come about as the result of human industriousness. None of the aforementioned are creations of modern man. (shrink)

El presente trabajo hace un análisis de la corta narración “decisión ante el trapecio”, escrita por el autor con motivo de la vida y obra del novelista Franz Kafka. Con ello se invita al lector ha reconocer en la aplicación del método (o enfoque) fenomenológico del “Análisis reflexivo”, una herramienta conceptual importante para lograr una mejor comprensión de las relaciones entre el arte y la filosofía. La soledad, el solipsismo y obviamente “las relaciones con el Otro”, son temas recurrentes tanto (...) a la literatura como a la fenomenología de Husserl, y por este motivo se propone el análisis partiendo de la narración literaria. Resumo: O ensaio a seguir tematiza o livro Viagem à Itália, no qual J. W. Goethe relata o período passado em território italiano, nos anos de 1786 e 1787. Procuro contextualizar essa viagem na vida e na carreira do escritor, servindo-me, para isso, especialmente de um texto sobre ele escrito por Walter Benjamin. Comento as observações de Goethe sobre a natureza, ligadas a suas pesquisas científicas, mas meu principal interesse são as observações sobre a arte e sobre a Antiguidade. Nestas, (...) identifico não só a importante influência do historiador da arte J. J. Winckelmann, como também a orientação para o classicismo, algo que marcaria a produção artística de Goethe a partir daquele período passado em território italiano.: The following paper discusses the book Italian Journey, in which J. W. Goethe described his travels in Italian territory in the years 1786 and 1787. I try to contextualize this journey within the writer’s life and career, referring especially to a text by Walter Benjamin. I comment on Goethe’s remarks on nature, which are linked to his scientific researches, but my main interest is in his remarks on art and classical antiquity. In these remarks, I recognize the important influence of the art historian J. J. Winckelmann and also a tendency toward classicism, something which defined Goethe’s artistic production from the time of his Italian travels onward. (shrink)

In a recent paper in this Journal San Pedro I formulated a conjecture relating Measurement Independence and Parameter Independence, in the context of common cause explanations of EPR correlations. My conjecture suggested that a violation of Measurement Independence would entail a violation of Parameter Independence as well. Leszek Wroński has shown that conjecture to be false. In this note, I review Wroński’s arguments and agree with him on the fate of the conjecture. I argue that what is interesting about (...) the conjecture, however, is not whether it is true or false in itself, but the reasons for the actual verdict, and their implications regarding locality. In November, 1991, the U.S. Congress enacted the U.S. Federal Sentencing Guidelines legislation which had a dramatic impact on corporate America. Can the Guidelines be used as a model or framework by other countries? Could other countries in the world benefit from adopting a similar piece of legislation? Are there any limitations to consider? In addressing these issues, the authors make the argument that the time has arrived for other countries to consider the development of legislation similar to the Guidelines (...) in order to improve organizational ethics. RESUMO:O objetivo de nossa exposição é mostrar que, em sua Carta a d’Alembert, Rousseau retoma o debate clássico sobre a relação entre o teatro e a moral nas mesmas bases estabelecidas por Platão. Sendo assim, a disputa sobre o teatro tem, da parte de Rousseau, uma objetividade que não encontramos no artigo de d’Alembert. Portanto, não se trata de uma diferença de opinião entre Rousseau e d’Alembert, mas da capacidade filosófica de bem compreender o que é próprio ao teatro e (...) à moralidade. ABSTRACTThe purpose of this article is to show how Rousseau, in his Letter to D’Alembert, takes up the classic debate between theatre and morals on the same grounds established by Plato. In Rousseau’s work, the debate about theatre has an objectivity that we do not find in D’Alembert’s article. Therefore, what is involved is not a difference of opinion between Rousseau and D’Alembert, but a difference in the philosophical ability to fully understand what concerns both theatre and morality. La Orientación Educativa en la Enseñanza Reglada.

Purpose The purpose of this paper is to propose an e-business assessment framework for organizations that aim to enhance the effectiveness of their online presence and maximize the benefits that result from it. The framework is based on three main pillars derived from the academic literature research: e-marketing strategies, customer relationship management strategies and business model strategies. Design/methodology/approach This paper reviews the literature from e-Marketing, CRM and business model strategies, leading to the generation of an e-Business assessment framework. Second, it (...) takes 19 case studies and analyzes them using ATLAS.ti, through qualitative content analysis, to validate that framework. Findings Pragmatic advice for practitioners derives from research results considering that this framework enables managers to characterize the company in terms of its e-business approach, making it possible to determine the level of depth of competitive online strategies. Lessons for an improved e-business approach can be derived from this paper. Originality/value This study proposes a novel e-business framework to assist organizations that want to have an online presence. This framework is comprised of the factors identified in the literature review that contribute to define and scope that online presence. The framework is then validated through the collection of 19 case studies of companies that have this online presence, validating the theoretical findings. (shrink)

En este artículo, trato de mostrar la pertinencia de Fenomenología de la percepción para responder a los desafíos de la filosofía en un mundo, a la vez, desgarrado y globalizador. Si dejamos de lado la dimensión teorética del mundo, recuperamos el fondo oscuro de la existencia, fondo de todos los espacios. Se trataría de un espacio primigenio en el que se encuentra el vínculo afectivo que es el propio de la experiencia de los niños y los primitivos. Lo vivido de (...) estos espacios implica empero una pérdida del espacio de juego gracias al cual «hay mundo», como apertura y posibilidad de intersubjetividad. Pero la respuesta ante el psicologismo de Merleau-Ponty supone un giro respecto a la filosofía tradicional al conseguir mantener cercana a su conciencia las conciencias otras del esquizofrénico o del niño. Humanitarian healthcare work presents a range of ethical challenges for expatriate healthcare professionals, including tragic choices requiring the selection of a least-worst option. In this paper we examine a particular set of tragic choices related to the prioritization of care and allocation of scarce resources between individuals in situations of widespread and urgent health needs. Drawing on qualitative interviews with clinicians, we examine the nature of these choices. We offer recommendations to clinical teams and aid organizations for preparing and supporting (...) frontline clinicians in their efforts to determine the least-worst option, and in their responsibility for making such choices. How and why did comparative political economy lose sight of the sources of growing macroeconomic and political instability, a problem that encompassed a growing financial bubble and then a crash in the housing market, a period of sluggish growth that plausibly constitutes secular stagnation, and a crisis of political legitimacy manifesting itself in the rise of antisystem “populist” parties? A gradual shift in CPE’s research agenda from macroeconomic to microeconomic concerns, and from demand-side to supply-side explanations, diminished its ability to (...) analyze adequately the central economic and political problems of the past twenty years. This article traces CPE’s evolution through successive “supermodels” that constituted its core research foci. To understand the current crisis, CPE needs to revisit and update its original roots in Keynes, macroeconomics, and the demand side. This shift is already happening at the margins, as CPE scholars struggle to understand the current crisis. (shrink)

O mundo da edição electrónica de periódicos encontra-se em permanente evolução, a par dos avanços tecnológicos e da crescente utilização de meios informáticos que facilitem o acesso à informação.A maioria das iniciativas que utilizam a edição electrónica de revistas tem como principal objectivo permitir aos investigadores um acesso fácil e centralizado à informação, alargando desta forma a potencial difusão das publicações consultadas.Partilhando alguns elementos deste princípio funcional, o Seminário Livre de História das Ideias (SLHI) propõe-se editar e estudar revistas históricas, (...) preocupando-se não apenas com a acessibilidade da informação mas também, e sobretudo, com a construção de um aparato analítico que permita uma leitura crítica das fontes. Discutir o seu trabalho e a sua experiência pode ser, pois, um passo importante para superar obstáculos e definir rumos para a edição electrónica de revistas. (shrink)

College students from small, medium, and large institutions with either a modified or no honor code were presented with cheating scenarios and asked to rate how dishonest they perceived the behavior to be and the likelihood that they would report it. No main effects were found for institution size or type of honor code. Student–faculty ratio was not correlated with responses to the cheating scenarios. Students from modified honor code schools perceived more severe punishments for cheating and understood the reporting (...) process better than students from non–honor code schools.
